Caregiver & Job Applicant Privacy Notice
Clare Senior Care AFC | GAFC, Inc. (“Clare Senior Care,” “we,” “us,” “our”)

This Notice explains how Clare Senior Care collects, uses, and protects the personal information of caregivers, job applicants, and prospective staff (“you”). It applies to data submitted through our websites, portals, forms, and hiring processes.
This Notice does not cover Protected Health Information (PHI) for patients or members, which is governed by our Notice of Privacy Practices (HIPAA). For general website visitors, see our Privacy Policy.
1) Information we collect
When you apply to work with Clare as a caregiver or staff member, we may collect:
- Identifiers: name, date of birth, address, phone, email.
- Government IDs: driver’s license, passport, Social Security number (SSN), work authorization.
- Employment history & qualifications: resumes, references, certifications, background checks.
- Financial information: banking details for stipends/payroll (direct deposit), tax forms (e.g., W-9).
- Health & screening data: TB test results, vaccination records, drug screening results (where required by law or program rules).
- Technical information: IP address, device/browser info when forms are submitted online.
2) How we use your information
We process your information to:
- Recruit, evaluate, and onboard caregivers and staff.
- Verify identity, credentials, and eligibility to work under MassHealth AFC/GAFC regulations.
- Complete background checks and required screenings.
- Set up payroll, caregiver stipends, and benefits administration.
- Communicate with you about applications, training, compliance, and role requirements.
- Meet legal and regulatory obligations (IRS, MassHealth, labor law).
We do not sell caregiver or applicant data.
3) Sharing your information
We may share your information with:
- MassHealth & state agencies for AFC/GAFC enrollment and compliance.
- Payroll and accounting providers (e.g., Zoho Books, banks).
- Background check and credential verification vendors.
- Training & certification partners (where you enroll in required courses).
- IT service providers (Zoho, GoHighLevel/LeadConnector, secure document storage).
- Government agencies when required by law.
All third-party vendors are contractually required to safeguard your data.
4) Data retention
We retain caregiver and applicant data only as long as necessary for:
- Hiring and onboarding decisions.
- Compliance with MassHealth, tax, and employment laws.
- Recordkeeping required by federal/state regulations.
If you are hired, your data will form part of your HR/contractor record. If not, we may retain certain records (e.g., application, screening) for legal or audit purposes.
5) Security
We use administrative, technical, and physical safeguards (encryption, secure storage, role-based access, staff training) to protect your data. However, no system is 100% secure. Please use care when sending sensitive information electronically.
6) Your rights
Depending on your state of residence, you may have rights such as:
- Access & copies: request access to the data we hold about you.
- Correction: ask us to correct inaccurate or incomplete information.
- Deletion: request deletion of your data (subject to legal limits).
- Restriction/objection: request limits on certain processing activities.
- Non-retaliation: we will not retaliate against you for exercising your rights.

7) Special notice for California (CPRA) and other states
If you reside in California or another state with employee/caregiver privacy laws, you have additional rights, including:
- The right to know categories and specific pieces of personal information collected.
- The right to delete personal information (with exceptions).
- The right to correct inaccuracies.
- The right to opt out of sale/sharing (Clare does not sell caregiver data).
- The right to limit use of sensitive personal information (e.g., SSN, health screening data).
8) International applicants
If you apply from outside the U.S., your information will be transferred to and processed in the United States. Where legally required, we will apply appropriate safeguards (e.g., Standard Contractual Clauses).
9) Changes to this Notice
We may update this Notice from time to time. The “Effective Date” above shows the latest version. Updates will be posted on our website.
