These Terms of Use (“Terms”) govern your access to and use of our websites, forms, and online portals (collectively, the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

The Site provides general information only. It does not provide medical advice, diagnosis, or treatment, and does not create a patient-provider relationship. For medical advice, consult your clinician. In an emergency, call 911 immediately.

3) Eligibility & acceptable use

  • Age: The Site is intended for individuals 13+. If you are under 13, do not use the Site. Some programs (e.g., SMS, job applications) may require 18+ or parental/guardian consent.
  • License: We grant you a limited, revocable, non-transferable license to access and use the Site for lawful, personal, non-commercial purposes.
  • Prohibited activities: You agree not to: (a) violate laws; (b) copy, modify, or create derivative works of Site content; (c) reverse engineer or interfere with the Site; (d) deploy malware, scraping, or data-mining without written consent; (e) circumvent access controls; (f) use the Site to harass, abuse, or infringe others’ rights.

4) Accounts, communications, and SMS

If you create an account or submit forms, you must provide accurate information and keep credentials confidential. By providing an email or mobile number, you consent to receive communications related to your requests and our services. Message/data rates may apply. 5) Intellectual property

The Site and its content (text, graphics, logos, photos, audio, video, code, and compilations) are owned by Clare Senior Care or our licensors and are protected by IP laws. Except as expressly permitted by these Terms, you may not reproduce, distribute, display, perform, or create derivative works from Site content without our prior written permission. All trademarks belong to their respective owners.

6) User submissions

If you submit information or materials (e.g., contact forms, resumes), you grant us a non-exclusive right to use that submission to operate the Site and deliver services consistent with these Terms, our Privacy Policy, and—where applicable—our NPP. Do not upload content you lack rights to share or that contains unlawful material.

7) Third-party links, embeds, and services

The Site may include links or embeds (e.g., maps, videos, scheduling widgets) from third parties. We do not control and are not responsible for their content, availability, or privacy/security practices. Review their terms and privacy policies before use.

8) Cookies & consent

We use cookies and similar technologies to operate the Site and, with consent, to measure performance (e.g., Google Analytics). 9) No warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND NON-INTERFERENCE. WE DO NOT WARRANT THAT THE SITE WILL BE SECURE, ERROR-FREE, OR UNINTERRUPTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CLARE SENIOR CARE OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID (IF ANY) TO ACCESS THE SITE IN THE PAST 12 MONTHS, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; THESE MAY NOT APPLY TO YOU.

11) Indemnification

You agree to defend, indemnify, and hold harmless Clare Senior Care and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or misuse of the Site.

12) DMCA/copyright

If you believe content on the Site infringes your copyright, notify us at clareteam@clare-afc.com with: (a) your contact info; (b) identification of the copyrighted work; (c) identification/URL of the allegedly infringing material; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act; and (f) your physical or electronic signature.

13) Termination; suspension

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason. Upon termination, provisions that by their nature should survive (e.g., IP, disclaimers, limitations of liability, indemnification, governing law) will survive.

14) Governing law; venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Suffolk County, Massachusetts for any dispute arising from or relating to these Terms or the Site.

15) International users

Accessing the Site from outside the U.S. is at your own risk. You are responsible for compliance with local laws. We may transfer and process data in the U.S. and other countries as described in our Privacy Policy and NPP.

16) Changes to the Site or these Terms

We may modify the Site and update these Terms at any time. The “Effective Date” above indicates the latest version. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

17) Accessibility & non-discrimination

We strive to make our Site accessible. Free language assistance and reasonable aids are available upon request. See our Non-Discrimination Policy or contact us using the details above.

18) Miscellaneous

  • Entire Agreement: These Terms, together with the policies linked above, are the entire agreement between you and us regarding the Site.
  • Severability: If any provision is found unenforceable, the remainder remains in effect.
  • No Waiver: Our failure to enforce any provision is not a waiver.
  • Assignment: You may not assign these Terms without our prior written consent.
